A code intended for one region, platform, edition, or account type may not work with another.

Using a virtual private network, false account location, or other method to bypass regional restrictions may violate third-party terms and is done entirely at the customer’s risk.

Merlap does not guarantee that a third-party platform will permit regional circumvention.

2.6 Game Account Information

Some top-up products require information such as:

  • Player ID;
  • User ID or UID;
  • Character ID;
  • Server;
  • Region;
  • Game nickname;
  • Platform; or
  • Account email.

Customers must provide complete and accurate information.

Do not provide:

  • Account passwords;
  • One-time security codes;
  • Recovery codes;
  • Private keys;
  • Complete payment card information; or
  • Other security credentials,

unless a specific secure process expressly requires such information.

Merlap is not responsible for failed or misdirected top-ups caused by incorrect customer information.

2.7 Orders

Submitting an order constitutes an offer to purchase the selected product.

An automated order acknowledgment confirms that the order has been received. It does not necessarily mean that the order has been accepted or fulfilled.

An order may be accepted when:

  • Payment has been approved;
  • Required verification has been completed;
  • The digital code has been issued;
  • The top-up process has started;
  • The digital product has been delivered; or
  • We otherwise confirm acceptance.

We may reject, suspend, or cancel an order because of:

  • Product unavailability;
  • Pricing or listing errors;
  • Payment failure;
  • Suspected fraud;
  • Unusual transaction activity;
  • Incorrect customer information;
  • Regional or platform restrictions;
  • Publisher or supplier limitations;
  • Compliance requirements;
  • Sanctions restrictions;
  • Technical errors; or
  • Violation of these Terms.

If we cancel an unfulfilled order after receiving payment, the amount paid for the cancelled product will be refunded.

2.8 Prices and Currency

Product prices are shown in the currency displayed on the website or selected during checkout.

Unless expressly stated otherwise:

  • Taxes may be added during checkout;
  • Foreign transaction fees are not included;
  • Currency conversion fees may be charged by the customer’s bank;
  • Payment providers may use their own exchange rates; and
  • Prices may change according to inventory, region, supplier costs, or promotional activity.

A price change after purchase does not entitle the customer to a refund or price adjustment.

If an obvious pricing error occurs, we may cancel the affected order and refund the amount paid.

2.9 Taxes

Customers are responsible for taxes, duties, charges, and reporting obligations applicable to their purchase, except where Merlap is required to collect and remit them.

Taxes may be calculated based on billing information, account location, delivery location, or other legally relevant information.

2.10 Payment

Available payment methods are displayed during checkout.

Payments may be processed by independent payment service providers. Their services may be governed by separate terms and privacy policies.

Customers confirm that:

  • The payment information is accurate;
  • They are authorized to use the payment method;
  • The transaction is not fraudulent;
  • They will not attempt to conceal the payment source; and
  • They will cooperate with reasonable payment verification.

Merlap does not normally store complete payment card numbers.

2.11 Payment and Identity Verification

Digital products can be delivered quickly and may be difficult to recover after fulfillment. Merlap may therefore conduct fraud and security reviews.

We may request:

  • Confirmation of billing details;
  • Confirmation of the account holder’s identity;
  • Proof of payment authorization;
  • Confirmation of order details;
  • Additional transaction information; or
  • Other reasonable verification.

Verification information should be provided only through an authorized secure channel.

An order may be delayed or cancelled if verification cannot be completed.

2.12 Digital Delivery

Digital delivery may occur through:

  • Email;
  • The customer’s Merlap account;
  • An order confirmation page;
  • Direct game account credit;
  • Electronic transfer;
  • A secure delivery link;
  • An external fulfillment provider; or
  • Another method stated on the product page.

Delivery times are estimates.

Most orders are processed shortly after successful payment. Some orders may take up to 24 hours or longer where manual verification, publisher maintenance, inventory issues, or technical problems occur.

2.13 Delivery Completion

A digital code order is considered delivered when the code has been:

  • Sent to the email address provided by the customer;
  • Displayed in the customer’s account;
  • Displayed on the order confirmation page; or
  • Otherwise made available through the stated delivery method.

A top-up order is considered delivered when:

  • The purchased credits have been applied to the account information supplied by the customer;
  • The fulfillment provider confirms successful delivery; or
  • The relevant third-party platform confirms completion.

Delivery confirmation does not prevent a customer from reporting a genuinely invalid code, incorrect product, or failed top-up.

2.14 Activation and Redemption

Customers are responsible for:

  • Following activation instructions;
  • Using the correct platform;
  • Maintaining access to the relevant account;
  • Entering codes accurately;
  • Confirming regional compatibility;
  • Keeping delivered codes confidential; and
  • Complying with third-party platform terms.

Once a code has been revealed, delivered, redeemed, or transferred, it may no longer be capable of being cancelled or resold.

2.15 Top-Up Services

For direct top-ups, the customer must verify all account details before payment.

Merlap is not responsible for credits delivered to an incorrect account where the information entered by the customer matched the information used to fulfill the order.

Top-ups cannot normally be reversed after the relevant game publisher, platform, or fulfillment provider confirms successful completion.

2.16 Order Changes and Cancellations

Cancellation requests must be submitted immediately.

An order may be cancelled only before:

  • A code has been issued or displayed;
  • A top-up has begun;
  • A digital product has been delivered;
  • An external fulfillment request has been submitted; or
  • Another irreversible fulfillment action has occurred.

Submitting a cancellation request does not guarantee that the order can be stopped.

2.17 Refunds

Refunds are governed by the Refund and Returns Policy.

Delivered, revealed, redeemed, consumed, or successfully applied digital products are generally non-refundable, except where:

  • The product is invalid;
  • The wrong product was delivered;
  • Fulfillment failed;
  • A duplicate charge occurred;
  • The product was materially misdescribed; or
  • A refund is required by applicable law.

2.18 Recurring Payments

Merlap will not enroll a customer in recurring billing unless the recurring nature of the purchase is clearly disclosed before payment.

Where recurring billing is offered, the checkout page will identify, as applicable:

  • The recurring price;
  • Billing frequency;
  • Renewal terms;
  • Trial terms;
  • Cancellation method; and
  • Material restrictions.

Customers may cancel recurring billing using the method described during purchase or by contacting Support@merlap.com.

Purchasing a fixed-term game membership code does not automatically create a recurring subscription unless checkout expressly states otherwise.

2.19 Third-Party Platforms

Digital products may be redeemed or used through third-party platforms.

Customers may be required to accept the platform’s:

  • Terms of service;
  • Privacy policy;
  • End-user licence agreement;
  • Community rules;
  • Regional restrictions; and
  • Account requirements.

Merlap does not control third-party platforms and cannot guarantee:

  • Continuous platform availability;
  • Continued game operation;
  • Server uptime;
  • Future game content;
  • Account eligibility;
  • Compatibility following platform updates;
  • Changes to publisher policies; or
  • The continuation of a third-party service.

2.20 Account Restrictions and Bans

Merlap is not responsible for a customer’s game account being restricted, suspended, or terminated because of:

  • Previous account conduct;
  • Violation of publisher rules;
  • Regional circumvention;
  • Account sharing;
  • Cheating;
  • Unauthorized software;
  • Payment disputes;
  • Fraud;
  • Abuse; or
  • Other activity unrelated to a proven error by Merlap.

A third-party account restriction does not automatically make a successfully delivered product refundable.

2.21 Product Sourcing and Intellectual Property

We seek to source digital products through lawful commercial channels.

A product will only be described as official, licensed, authorized, or publisher-approved where there is a reasonable basis for that description.

Game titles, platform names, publisher names, logos, artwork, and trademarks belong to their respective owners.

Unless expressly stated, reference to a third-party product does not imply sponsorship, authorization, endorsement, or partnership.

2.22 Prohibited Use

You must not use Merlap to:

  • Conduct fraud;
  • Use stolen payment information;
  • Launder money;
  • Evade sanctions;
  • Abuse promotions;
  • Circumvent purchasing limits;
  • Resell products without authorization;
  • Test unauthorized payment methods;
  • Access another person’s account;
  • Distribute malware;
  • Scrape website data;
  • Interfere with website security;
  • Submit false refund claims;
  • Initiate abusive chargebacks;
  • Violate intellectual property rights; or
  • Engage in unlawful activity.

We may suspend or terminate access where prohibited conduct is suspected.

2.23 Customer Accounts

Customers are responsible for:

  • Protecting account credentials;
  • Maintaining an accurate email address;
  • Restricting access to their devices;
  • Reviewing account activity; and
  • Reporting suspected unauthorized access.

We may suspend accounts associated with fraud, abuse, payment disputes, sanctions concerns, or repeated violations.

2.24 Reviews and Submitted Content

If you submit a review, image, comment, or other content, you confirm that:

  • You have the right to submit it;
  • It is accurate and lawful;
  • It does not infringe another person’s rights;
  • It does not contain confidential information;
  • It is not deceptive or defamatory; and
  • It does not contain harmful code.

You grant Merlap a non-exclusive, worldwide, royalty-free licence to display and use the submitted content in connection with our business.

2.25 Website Availability

We do not guarantee uninterrupted or error-free access to the website.

We may suspend or restrict access for:

  • Maintenance;
  • Security;
  • Technical updates;
  • Fraud prevention;
  • Legal requirements;
  • Supplier interruption; or
  • Operational reasons.

2.26 Disclaimer

To the maximum extent permitted by law, the website and services are provided on an “as available” basis.

We do not guarantee that:

  • Every product will remain available;
  • Every third-party platform will remain operational;
  • A game publisher will maintain a product indefinitely;
  • A game will remain available in every region;
  • A platform will not change its activation procedures; or
  • Website access will always be uninterrupted.

Nothing in these Terms excludes any warranty or consumer right that cannot legally be excluded.

2.27 Limitation of Liability

To the maximum extent permitted by law, MENSWEAR OUTLET LLC will not be liable for indirect, incidental, special, punitive, or consequential losses arising from:

  • Third-party platform downtime;
  • Incorrect account details;
  • Incorrect platform or region selection;
  • Customer account restrictions;

  • Unauthorized disclosure of a delivered code by the customer;

  • Events outside our reasonable control.

Where liability cannot be excluded, it will be limited to the amount paid for the affected order, except where applicable law requires otherwise.

Nothing in these Terms limits liability for fraud, willful misconduct, or any liability that cannot legally be limited.

2.28 Indemnification

To the extent permitted by law, you agree to indemnify MENSWEAR OUTLET LLC against losses and claims arising from:

  • Sanctions and regulatory restrictions.

2.30 Governing Law

These Terms are governed by the laws of the State of Colorado and applicable federal laws of the United States.

Subject to mandatory consumer rights, disputes relating to these Terms will be handled by courts with appropriate jurisdiction in El Paso County, Colorado.

2.31 Changes to These Terms

We may update these Terms periodically.

Updated Terms will be posted on the website with a revised effective date. Changes will not retroactively reduce rights relating to a completed order unless permitted by law.
